The rules of the road

Please read these terms carefully before using Last Letter. They cover what we promise, what you take responsibility for, and the limits of the service.

Important notice

Last Letter is a digital service designed to help deliver personal messages. While we strive for reliability, we cannot guarantee 100% delivery due to factors beyond our control. Please consider this service as a supplement to — not a replacement for — traditional estate planning. It is not a legally binding substitute for a last will and testament, and nothing in this service constitutes legal, financial, or professional advice of any kind.

§ 01

Acceptance of terms

By creating an account and using Last Letter, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our service. Your continued use of the service after any changes to these terms constitutes your acceptance of the updated terms.

§ 02

Service description

Last Letter is a digital message delivery service that:

  • Stores messages you create for future conditional delivery.
  • Monitors your regular check-ins to determine when to send messages.
  • Contacts a trusted contact (for eligible paid users) for verification when you miss check-ins.
  • Delivers messages to designated recipients under specified conditions.

Last Letter is a personal communication tool only. It is not a legal document platform, estate management service, or emergency notification system.

§ 03

Eligibility & user responsibilities

Minimum age. You must be at least 18 years old to use this service. By registering, you confirm that you meet this requirement. We do not knowingly collect data from anyone under 18. If we discover an account belongs to a minor, we will terminate it immediately.

Account security. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account. Notify us immediately if you suspect unauthorised access.

Real email required. You must register with a real, permanent email address that you own and have legitimate access to. The use of temporary, disposable, or anonymous email addresses is strictly prohibited. Accounts registered with such addresses may be terminated without notice.

Accurate information. You must provide accurate and current information, including valid email addresses for yourself, recipients, and trusted contacts. Inaccurate information may result in failed or misdirected message delivery, for which we bear no responsibility.

Regular check-ins. You are solely responsible for checking in regularly according to your chosen schedule. Failure to do so may trigger the delivery of your messages. We are not responsible for accidental delivery caused by your inactivity.

Content responsibility. You are solely and entirely responsible for the content of your messages. You must ensure they comply with all applicable laws in your jurisdiction and do not harm, harass, defame, or distress the recipients.

Recipient responsibility. By designating recipients, you confirm that you have a legitimate personal relationship with them and that you take full moral and legal responsibility for any impact the messages may have upon delivery. Recipients have not consented to receive messages through this platform — you are acting as the sender, and we are acting solely as a delivery mechanism on your behalf.

§ 04

Prohibited content & uses

You may not use Last Letter to store or send messages that contain:

  • Illegal content or instructions for illegal activities.
  • Harassment, threats, intimidation, or abusive language directed at any person.
  • Content designed to cause emotional distress, psychological harm, or financial harm to recipients.
  • Spam or unsolicited commercial content.
  • Malicious code or links to harmful websites.
  • Content that infringes on intellectual property rights.
  • Personal information of others shared without their consent.
  • Impersonation of any person or entity.
  • Content that glorifies, encourages, or details self-harm or harm to others.

We reserve the right to remove any content that violates these terms and to terminate accounts engaged in prohibited use without notice or refund.

§ 05

Service limitations & disclaimers

No delivery guarantee. While we strive for reliable service, we cannot guarantee message delivery. Factors including but not limited to email filtering, spam systems, recipient inbox issues, technical failures, or service interruptions may affect delivery. We are not liable for undelivered messages.

Verification process. The trusted contact verification process is designed to reduce false alarms, but it is not foolproof. We make no guarantee of its accuracy or effectiveness in any specific situation.

False positive delivery. There is an inherent risk that messages may be sent while the account holder is still alive — for example, due to missed check-ins, email issues, or other failures. By using this service, you fully acknowledge and accept this risk. Once messages are delivered, they cannot be recalled, deleted, or intercepted from recipient inboxes.

No emergency use. Last Letter is not intended for use in emergencies or time-sensitive situations. Do not rely on this service to communicate urgent, medical, legal, or critical information.

No legal or professional advice. Nothing in this service — including its design, features, or any communications from us — constitutes legal, financial, psychological, or estate planning advice. Always consult qualified professionals for such matters.

Emotional impact. By its nature, this service involves sensitive topics including mortality, grief, and loss. We are not responsible for any emotional, psychological, or mental health impact experienced by you, your recipients, or your trusted contacts.

Third-party services. We rely on third-party platforms (including Supabase, Netlify, and Resend) to operate. We are not liable for failures, outages, data breaches, or policy changes by these providers that affect the delivery or storage of your data.

Technical issues. We are not liable for service interruptions, data loss, or technical failures beyond our reasonable control.

Message reception. We cannot guarantee that recipients will open, read, or respond to delivered messages. Delivery to an inbox does not ensure the message was seen.

§ 06

Payment and subscriptions

Free plan. Our free plan includes basic features with limitations on messages and recipients.

Paid plans. Additional features are available through Buy Me a Coffee. Payments are processed by Buy Me a Coffee and subject to their terms. We do not store payment card information.

Refunds. Due to the nature of digital services, refunds are generally not provided once a plan has been activated. Contact us at support@lastletter.app for exceptional circumstances, which we will review at our discretion.

Plan expiry. Paid access expires according to your plan terms. Upon expiry, your account reverts to the Free Plan. Existing messages are not deleted, but plan-restricted features will be paused.

§ 07

Account termination

By you. You may delete your account at any time from your Profile page, which will permanently remove all your data and messages. Deletion is irreversible.

By us. We may suspend or terminate accounts without prior notice if they violate these terms, engage in harmful activities, or are found to be operated by a minor. No refunds will be issued for terminated accounts.

Data deletion. Upon account termination, all stored data is permanently deleted within 30 days. Messages that have already been delivered to recipients cannot be recalled.

§ 08

Message delivery disclaimer

Last Letter provides a time-triggered messaging system based on user-defined preferences and verification rules.

By using this service, you acknowledge that messages will be sent if verification steps are not completed within the timeframe you selected — regardless of whether you are alive or not.

Once messages are delivered to recipients, they cannot be recalled, deleted, or intercepted.

You are solely responsible for keeping your contact information accurate, your inactivity window appropriate, and your check-in schedule maintained.

§ 09

Indemnification

You agree to indemnify, defend, and hold harmless Last Letter, its operators, contributors, and service providers from and against any claims, liabilities, damages, losses, or expenses (including legal fees) arising out of or related to: (a) your use of the service; (b) your violation of these terms; (c) the content of your messages; (d) any harm caused to recipients, trusted contacts, or third parties as a result of messages delivered through this service.

§ 10

Limitation of liability

Last Letter is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

To the maximum extent permitted by applicable law, we are not liable for any indirect, incidental, special, consequential, punitive, or exemplary damages — including loss of data, emotional distress, or message delivery failures — arising from your use of or inability to use this service.

Our total cumulative liability to you for any claims under these terms shall not exceed the total amount you have paid us in the 12 months preceding the claim, or $10 USD, whichever is greater.

§ 11

Force majeure

We are not liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to: natural disasters, acts of government, war, civil unrest, internet outages, third-party platform failures, cyberattacks, or changes in laws or regulations that affect our ability to operate.

§ 12

Dispute resolution

Good-faith resolution. Before initiating any formal dispute, you agree to contact us at support@lastletter.app and give us a reasonable opportunity (at least 30 days) to resolve the issue informally.

No class actions. You agree to resolve any disputes with us on an individual basis. You waive any right to participate in a class action lawsuit or class-wide arbitration against Last Letter.

Governing law. These terms are governed by applicable law to the extent required by your jurisdiction. We make no representation that the service is appropriate or available in all locations.

§ 13

Severability & entire agreement

Severability. If any provision of these terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect.

Entire agreement. These Terms of Service and our Privacy Policy constitute the entire agreement between you and Last Letter regarding your use of the service and supersede any prior agreements or understandings.

No waiver. Our failure to enforce any right or provision of these terms does not constitute a waiver of that right or provision.

§ 14

Changes to terms

We may update these Terms of Service from time to time. We will update the date at the bottom of this page when changes occur. It is your responsibility to review the terms periodically. Continued use of the service after changes are posted constitutes acceptance of the updated terms.
